Buying a Resale Apartment in Finestrat

Buying a resale apartment in Finestrat: nearly new and key-ready

You arrive at the complex and the views are no longer a promise. There are people at the pool, the gardens have grown, and from the terrace you can see exactly what has been built in front. Buying a resale apartment in Finestrat, Spain, in the hills rising from the AP-7 towards Sierra Cortina, Balcón de Finestrat or Finestrat Hills, doesn’t mean buying an old flat.

This is a newly built area, so most of what’s sold here as resale isn’t old but recent and key-ready. You get a modern building without waiting for a development to finish. Even so, it’s worth checking it for what it is: a home with an owner, a community and a history.

Resale or new build in the Finestrat hills?

Both options exist side by side here, often on the same street, and they’re more alike than in other areas. These are the differences that matter most:

  • Timing: a resale apartment can be ready as soon as the sale completes, with no wait for a handover date.
  • What you see: you can check the real light, noise, views and atmosphere, not a render.
  • The community: you can review actual fees, minutes and accounts instead of relying on an estimate.
  • Taxes: resale generally carries 9% transfer tax (ITP), or 11% above €1 million, while new build carries 10% VAT (IVA) plus 1.4% stamp duty (AJD).
  • Condition: a new build is unused; with resale, look at how it has actually been used, especially as a holiday let.

What a “nearly new” apartment can still hide

The issues here usually aren’t those of an old building. Before you sign the arras (deposit) contract, pay attention to the following:

  • Building guarantees: the guarantees under Spain’s building law (LOE) continue for their set periods even if the home is sold: 1 year for finishes, 3 for habitability and 10 for structure. Check the completion date and ask for the 10-year insurance policy (seguro decenal).
  • Building defects: read the community minutes. They can reveal damp, leaks or claims against the developer.
  • Communal costs: a spa, gym or several pools also mean maintenance costs and possibly future levies.
  • What’s included: if it’s sold furnished, get an inventory of furniture and appliances in writing.
  • A non-resident seller: if the seller lives outside Spain, you must withhold 3% of the price and pay it to the tax office using form 211.

I’ll check it before you sign

I’m Martyna Kamińska, a licensed agent (API no. A419, RAICV no. 2891), and this is the kind of purchase where a second pair of eyes helps most. I go through the nota simple (land registry extract), the Catastro (property register), the community and the arras contract with you, and explain them in English, Spanish or Polish.

If you want to change anything afterwards, you can rely on our network of lawyers, tax advisers, interior designers and renovation teams, so you won’t have to search from abroad. We work across the Costa Blanca and Costa Cálida.

Frequently asked questions about resale apartments in Finestrat

Are resale apartments in Finestrat old?
In the hills, generally not: this is a newly built area, and most resale apartments are recent and key-ready. Even so, I’d always check the completion date of the building.

Is resale cheaper than new build in Finestrat?
Not always: it depends on the complex, the views, the condition and the taxes in each case. I’d compare the total cost of both options, not just the advertised price.

Do I need a survey on a nearly new apartment?
It isn’t compulsory, and a survey isn’t automatically part of a purchase in Spain. I’d still consider one if you’ve spotted damp, cracks or signs of repairs, or if the community minutes mention building defects.

Can I keep renting it out to holidaymakers?
Don’t take it for granted, even if it’s already let. Check current regulations, the community statutes and the property’s administrative status before you count on that income.

Can you check an apartment I’ve found myself?
Yes, I offer buyers a verification service, even if they didn’t find the property through me. It’s best to show it to me before you sign the arras contract, while you have more room to negotiate or walk away.
